Hastanede doktora saldırı: Hastane yönetimi hizmeti durdurdu

Gerede Devlet Hastanesi’nde görev yapan Kadın Hastalıkları ve Doğum Uzmanı Dr. Halime Şen Selim’in hasta yakını tarafından tehdit ve hakarete maruz kalması üzerine hastane yönetimi hasta bakmayı durdurarak sadece acil ve yoğun bakım hastalarına bakma kararı aldı. Görev yapan Doktor Halime Şen Selim’e hasta yakınının “Siz ölmeyi hak ediyorsunuz, siz doktorları öldürmek lazım” diyerek tehdit ve çeşitli hakaretlerde bulunduğu öğrenildi. Doktor Halime Şen Selim savcılığa şikayette bulundu.

Meb, Okullardaki Güvenlik Sorununu Nasıl Çözecek?

Avrupa İnsan Hakları Mahkemesi 2. Dairesinin 10/07/2012 tarihli KAYAK Kararında; Devletin, yasamın korunması ile ilgili koruyucu tedbir alma sorumluluğunun bulunduğu aşikardır. Mevcut davada, söz konusu olanın bir okul olduğu ve okulların suçu önleme konusunda doğal olarak emniyet birimleri ile aynı imkanlara sahip olamayacaklarını gözden kaçırmamak gerektiğini ve ayrıca AİHM'nin güvenlik güçlerinin görevlerine ilişkin içtihadı ışığında ortaya konan ilkeleri hatırlatmanın yararlı olduğu, Okul müdürünün okul girişine güvenlik kulübesi yapılmasına dair talebinin karşılanmadığını göz önünde tutmakla birlikte, bu tedbirin öncelikle öğrencilerin okul dışından yabancı şahısların saldırgan tutumlarından korunmalarına yönelik olduğu, Yetkili makamların okul idaresinin pencerelere demir parmaklık takılması ve emniyet birimlerinden destek isteği de dahil güvenlikle ilgili taleplerini dikkate almamaları vurgulanmıştır.

MEB Avrupa İnsan Hakları Mahkemesi 2. Dairesinin 10/07/2012 tarihli KAYAK Kararı üzerine yeni olaylarda yeni tazminat davalarının gündeme gelmemesi için il milli eğitim müdürlüklerine istatistiki bilgileri derleyecek yazılar göndermektedir.

İlk yazı aşağıda yer verdiğimiz haberimizde ki 22/10/2015 tarih ve 10790983 sayılı yazıdır. Bu yazı ile Avrupa İnsan Hakları Mahkemesi 2. Dairesinin 10/07/2012 tarihli KAYAK Kararının icrası sürecinin Avrupa Konseyi AİHM Kararlarının İcra Dairesi (AKİD) tarafından takip edildiği, bu nedenle, AKİD'e sunulacak eylem planında/raporunda yararlanılmak üzere, karara konu olayla ilgili benzer olayların yaşanmaması adına ne gibi önlemler alındığına ilişkin ile istatistiki bilgi talep edilmiştir.

Şimdi ise aynı süreç devam etmekte aşağıdaki yazı ile tekrar istatistiki bilgi talep edilmektedir.

Fakat Bilindiği üzere 19. Milli Eğitim Şurası Genel Kurulunda ele alınan konulardan biriside Okul Güvenliğiydi ve kurulda "Okulda fiziksel güvenliği sağlamak amacıyla, bütün okullarda güvenlik görevlisi ve sağlık personeli hizmet alımı yoluyla görevlendirilmelidir." kararı alınmıştır.

Hatta Milli Eğitim Bakanlığı İnsan Kaynakları Genel Müdürlüğü 04.02.2015 tarih ve 1222428 sayılı yazılarında;

Milli Eğitim Bakanlığı Okul-Aile Birliği Yönetmeliğinin "Birliğin görev ve yetkileri" başlıklı 6. maddesi 1.fıkrası (d) bendindeki; "d) Okulun ihtiyaçlarını karşılamak için mal ve hizmet satın almak, bu hizmetlere ilişkin sosyal güvenlik primi, vergi ve benzeri ödemelerin yapılmasını sağlamak." hükümleri ile,

Milli Eğitim Bakanlığı Okul Öncesi Eğitim Ve İlköğretim Kurumları Yönetmeliğinin "Diğer personel" başlıklı 50. maddesi 3.fıkrasındaki; "(3) Kadrolu personel dışında, ücretleri genel bütçe veya bütçe dışı kaynaklarca karşılanarak hizmet satın alma yoluyla çalıştırılacak personelin görevlerine ilişkin esas ve usuller sözleşmeyle belirlenir." hükümleri ile,

Milli Eğitim Bakanlığı Özel Öğretim Kurumları Genel Müdürlüğünün 2014/20 nolu genelgesinin; "6.2. Okulların güvenliğinin güçlendirilmesinde, özel güvenlik marifeti ve güvenlik kamaralarının kullanılmasına yönelik imkanların sağlanması," hükümleri ile okullarda özel güvenlik görevlisi çalıştırılabileceğini açıklamıştır.

Emniyet güçlerinin bile güvenliği sağlamakta zorlandığı durumlarda öğretmenler okullarda güvenliği nasıl sağlayacak. Kaldı ki 1739 sayılı Milli Eğitim Temel Kanunu'nun "Öğretmenlik" başlıklı 43/1 maddesindeki"Öğretmenlik, Devletin eğitim, öğretim ve bununla ilgili yönetim görevlerini üzerine alan özel bir ihtisas mesleğidir." hükümlerine göre; öğretmenlik Devletin eğitim, öğretim ve bununla ilgili yönetim görevlerini üzerine alan özel bir ihtisas mesleğidir. bu mesleğin görevi güvenliği sağlamak değildir. Huzurlu ve güvenli bir ortamda eğitim, öğretim faaliyetinde bulunmaktır.

Hal böyle iken Milli Eğitim Bakanlığı 17.09.2015 tarih ve 9367301 sayılı yazılarında okullarda güvenliği öğretmene emanet etmiştir.

Buna göre;

1- Okullarda eğitim ve öğretim gören öğrencilerimizi oluşabilecek zararlardan korumak ve güvenliğini sağlamak için koruma ve güvenlik görevlilerine ihtiyaç duyulmaktadır.

2- Bakanlık tarafından ödeneği gönderilmek üzere hizmet alım yoluyla koruma ve güvenlik görevlileri alınmalı veya okul aile birliğinin kararı doğrultusunda hizmet alımı yoluyla alınmalıdır.

3- Okula koruma ve güvenlik görevlisi alınabilmesi için, İl Koordinasyon Kurulu kararları alınmış olması gerekmektedir.

4- Koruma ve güvenlik görevlileri, güvenlik eğitimi ve hizmeti veren firmalarının gireceği bir hizmet alımı sonucunda belirlenmelidir.

5- Koruma ve güvenlik görevlilerine pedagojik eğitim verilmelidir.

6- okul girişlerine manyetik detektörler ve kimlik kartı ile giriş sistemleri kurulmalıdır.

Kurumların bütçeleri görüşülmeye başlandı

TBMM Genel Kurulunda, Cumhurbaşkanlığı, TBMM Başkanlığı, Başbakanlık ile Sayıştay, Yargıtay, Danıştay ve Anayasa Mahkemesi bütçelerinin görüşülmesine başlandı.

Genel Kurul, Başkanvekili Ahmet Aydın başkanlığında toplandı.

2016 yılı Bütçe Kanunu Tasarısı görüşmelerinin birinci turunda; Cumhurbaşkanlığı, TBMM Başkanlığı, Başbakanlık ile Sayıştay, Yargıtay, Danıştay ve Anayasa Mahkemesinin yanı sıra, Kamu Denetçiliği Kurumu, MİT Müsteşarlığı, MGK Genel Sekreterliği, Diyanet İşleri Başkanlığı, RTÜK, Basın Yayın ve Enformasyon Genel Müdürlüğü ile Türkiye İnsan Hakları Kurumunun bütçeleri de görüşülecek.

SMS Kısa Mesaj Devri Bitiyor Artık RCS Geliyor

Yıllardır kullandığımız kısa mesaj servisi sms, artık yerini diğer internet üzerinden kullanılan ve daha pratik olan WhatsApp olmak üzeri birçok online mesajlaşma servisi platformuna bıraktı. SMS'in devrini bitiren whatsapp, skype, mesenger gibi servisler, SMS kullanımını azalttı fakat tam anlamıyla bitiremedi. SMS kullanımı, akıllı telefonların sayısı arttıkça bitiyor. Google ve GSMA, SMS ve MMS'i tekrar popüler hale getirebilmek için kolları sıvadılar. Google bu adımı attıktan sonra, SMS kısa mesaj servisi, var olan online mesajlaşma platformları ile tekrar yarışabilecek duruma gelecek mi bekleyip göreceğiz. SMS'i tekrar insanlara kabul ettirmek ise o kadar kolay olmayacak. Bu yüzden SMS sisteminin geliştirilmiş bir versiyonun verilmesi gerekiyor. Bu yeni girişim sonrası SMS'in daha gelişmiş bir versiyonu olan RCS (Rich Communications Services) SMS'e göre çok daha gelişmiş olacak. Bu yeni mesajlaşma standardı kullanıcılara daha iyi grup sohbeti özellikleri, yüksek çözünürlüklü fotoğraf ve dosya paylaşımı, video arama hizmetleri, makbuz okuma gibi yenilikler getirecek.

Bu sistemin geçisi online mesajlaşma sistemleri ile RCS yarışını başlatır mı bilinmez ama Google bu sistemin üzerine gidecek gibi görülüyor. RCS sistemi ile ilgili gelişmeleri sizlere aktarmaya devam edeceğiz.

Google'dan android telefonlara sohbet uygulaması

Kısa mesaj servisi yani daha bilindik, yaygın adı ile SMS, artık mobil cihaz kullanıcıları tarafından unutulmaya yüz tutmuş durumda. Bunun sebebi ise sosyal medya platformlarının sunduğu, daha işlevsel mesajlaşma sistemleri. Whatsapp da bunda dahil elbette.

Çalışmalarına başlayan Google, bütün Android cihazlarda kullanılabilecek ve Rich Communications Services (RCS)'e uygun bir mesajlaşma platformu geliştirdi (RCS dünya genelinde iletişim kalitesinin belirlendiği bir çalışma).

ünya genelinde 800'e yakın GSM operatörünün bağlı olduğu GSMA, yaptığı duyuruda Google'ın evrensel bir RCS müşteri profili oluşturarak, GSMA bünyesindeki GSM operatörlerine sunacağı belirtti.

Webtekno'nun haberine göre Google'ın RCS'ye uygun bir mesajlaşma platformu kurması demek, mesajlaşırken fotoğraf, video gönderebilmeniz, grup konuşmaları yapabilmeniz demek. Yani telefonunuzda Whatsapp tarzı bir SMS sistemi olduğunu düşünebilirsiniz.

Jibe adı verilen bu platform, Android cihazlarına özel olacak ve GSM operatörleri tarafından desteklenecek. Benzer sistemi Apple, iPhone kullanıcılarına iMessage ile halihazırda sunuyor.

Öğretmenin tacizine dayanamadı

Melikgazi'de lisede okuyan 12'nci sınıf öğrencisi Cansel, öğretmeni Bayram Ö.'nün cinsel istismarına uğrayınca durumu önce arkadaşlarıyla ardından öğretmenleriyle paylaştı.

İddiaya göre okul yönetimi olayın üzerini kapatmak istedi. Şikayetlerinden sonuç alamayan Cansel, çarşamba günü evinde babasının tabancasıyla kendisini başından vurdu. Ağır yaralanan Cansel, hastaneye kaldırıldı ancak kurtarılamadı. Cansel Kırşehir'de toprağa verildi.

Öğretmenin tacizine dayanamadı

Cansel'in ailesi olayla ilgili şöyle konuştu: "Okul yönetimine şikayet etmiş fakat olayın üstü kapatılmak istenmiş. Olaydan bütün arkadaşlarının haberi var. Matematik öğretmeni Kayseri Kapalı Cezaevi'nde. Mahkemede suçunu itiraf etmiş. Öğretmen, okul yönetimi ve hatta Milli Eğitim Bakanlığı hakkında tazminat davası açacağız. Sorumluların ceza alması için elimizden gelen ne varsa yapacağız."
